PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS PLATFORM.

 

Thank you for visiting or using this website via computer, mobile phone, tablet, console or other device (collectively, “Device”).  By accessing and using this website (the “Platform”), such as placing orders on this website, you signify that you have read, understand and agree to be bound by these Terms of Use and any other applicable law, whether or not you are a registered member of the Company.  The Company may change these Terms of Use at any time without notice, effective upon its posting to the Platform.  Your continued use of the Platform shall be considered your acceptance to the revised Terms of Use.  If you do not agree to these Terms of Use, please do not use this Platform. 

 

Intellectual Property 

All intellectual property on the Platform (except for User Generated Content) is owned by the Company or its licensors.  All trademarks, service marks and trade names are owned, registered and/or licensed by the Company.  All contents on the Platform (except for User Generated Content), interactive features and all other content (the “Content") is a collective work under the copyright laws of Hong Kong and is the proprietary property of the Company.  All rights reserved.  You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify the Company trademarks in any way, without the prior written consent of the Company.  The use of the Company trademarks is prohibited without the express written consent of the Company. 

 

Platform Use Restrictions 

You may use the Content only for your own non-commercial use to participate in the Platform or to place an order or purchase the Company products.  You agree not to change or delete any ownership notices from materials downloaded or printed from the Platform. You agree not to modify, copy, translate, perform, display, distribute, frame, reproduce, republish, download, post, transmit or sell any Intellectual Property or Content appearing on the Platform, including User Generated Content (defined below) unless it is your own User Generated Content that you legally post on the Platform.  You agree not to use any data mining, robots, scraping or similar data gathering methods.  Nothing in these Terms of Use shall be interpreted as granting any license of intellectual property rights to you. 

 

Product Orders 

Price and other information of goods presented on the Platform is only an invitation for offer and your order shall be deemed as an offer.  All orders placed through the Platform are subject to the acceptance of the Company.  Your order is accepted by the Company, and the purchase contract between the Company and you is formed, only when the Company sends you the confirmation.  If you have ordered more than one product under a single order, the purchase contract is formed only in relation to the product(s) for which the Company has issued a confirmation email.  This means that the Company may refuse to accept or may cancel any order, pursuant to these Terms of Use or for any other legitimate reason, and without liability to you or anyone else. 

 

No Purchase for Resale 

The Platform is intended to sell the Company products direct to end consumers solely, purchase for resale in any form is not permitted.  

 

Cancellation of Orders

You agree that the Company can cancel your order (and, if applicable, refund the relevant payment through your original payment platform) and take all necessary legal actions to protect its rights and interests, without any compensation under the following circumstances:

- Information of the product on the Company’s website is obviously erroneous or the product is out of stock;

  Pricing errors;

- Platform technical problems;

- Your order information is erroneous or your order quantity exceeds the stock;

- Due to force majeure, transportation delay, system failure or third-party attacks of the Company’s website, and other circumstances beyond the control     of the Company, the Company finds it necessary to cancel your order;

- You fail to complete payment within the specified time;

- the Company finds that you hack the Company’s network to purchase the Company’s products;

- the purpose of purchasing the Company’s products is for resale; or

- breach of other Terms of Use, Purchase Terms and Conditions or other regulations or policies of this Platform, or restricted or forbidden acts in website    activities, or circumstances in breach of principles of fairness and honesty (for example, you repeatedly refuse to accept the order of goods without  legitimate reason or maliciously reserve the stock, etc.).

 

Safeguard Your Username/Password 

You are responsible for any actions that take place while using your account with the Company.  The Company is not responsible for any loss that results from the unauthorized use of your username/password, with or without your knowledge. 

 

User Generated Content 

"User Generated Content" is communications, materials, information, data, opinions, photos, profiles, messages, notes, website links, text information, music, videos, designs, graphics, sounds, and any other content that you and/or other Platform users post or otherwise make available on or through the Platform, except to the extent the Content is owned by the Company. 

 

We may take actions against your account for activities (such as terminate your account) at our sole discretion without notice to you, if you: 

- use any technology to attempt to hide the use of multiple accounts or disrupt any of our Platform in any way;

- initiate User Generated Contents that contain any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, or    racially, ethnically or otherwise objectionable material;

- advertise or send unsolicited messages of any kind; or

- impersonate others or provide any kind of false information.

 

You are solely responsible for your User Generated Content, your interactions with other users and your activity on the Platform.  Do not take any action or post anything that may the Company or its users to any harm or liability of any type. 

 

Eligibility to Purchase

In order to place orders with us, you must meet our conditions of eligibility: 

- Be aged 18 years of age or over;

- Be in possession of a valid credit/debit card issued by a licensed bank acceptable to the Company for payment or be in possession of a valid PayPal  account; and

- Providing personal and payment details that are warranted by you to be both valid and accurate (email address, real name, phone number, billing information and other requested information as indicated on the Platform).

 

In placing an order with us, you authorize us to process a charge or charges on your credit/debit card or PayPal account in the amount of the total purchase price of your order.  You also expressly authorize us to use personal information provided by you to perform appropriate anti-fraud checks such as credit checks and also to, where necessary, transmit or obtain information about you to or from third parties including, but not limited to, credit reference or fraud-prevention agencies, which may keep a record of that information.  Please refer to our Privacy Policy for further information about how we use your data.

 

All orders are subject to stock availability and confirmation.  Items in your shopping basket are not reserved and may be purchased by other customers.  

 

Product Description

The Company will endeavor to ensure that the Content and the product descriptions on the Platform to be accurate and complete as possible.  We however do not warrant that Content and product descriptions are accurate, complete, current or error-free.

 

Pricing

Prices are shown on the Platform in Hong Kong Dollars (HKD).  Prices displayed on the Platform at the time your order is accepted will be honored except in the case of obvious error. Whilst we use our best endeavors to ensure that all prices appearing on the Platform are accurate, we do not guarantee that they are error-free and reserve our right to rectify any errors.  If we discover an error in the price of any products that you have ordered, we will inform you as soon as possible and offer you the option of reconfirming or cancelling your order.  If we are unable to contact you, we will treat the order as cancelled.  

If your credit/debit card is not denominated in Hong Kong Dollars (HKD), the final price charged in your currency will be calculated by your issuing bank in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

 

Payment 

We accept payments made by Visa, MasterCard, American Express and PayPal.  By placing an order using one of the above Credit/Debit card and online payment methods, you confirm that the Credit/Debit card(s) or PayPal account used is yours or that you have been authorised by the owner to use it.  If your card issuer refuses to authorize payment to the Company, we will not be liable for any delay or non-delivery. 

 

Our payment processes meet the stringent international security standards set down by the Payment Card Industry to make your shopping experience safe and secure.  In the absence of negligence on our part, we will not be liable for any loss you may suffer if any third party procures unauthorised access to any data you provide when using the Platform. 

 

Acceptance of your Order

Once you have entered your personal and order details and we have received your payment, we will send you a confirmation email.  Upon which, your order will be accepted and the contract between you and the Company is completed.  All sales contracts are therefore concluded in Hong Kong SAR and are written in English.  The Company reserves its right not to accept an order for any reason at its sole discretion.  We will contact you as soon as possible if there are any problems with your order.

 

Shipping and Collections

You accept the responsibility for the products ordered upon delivery.  If the recipient or collector is not the original purchaser, or in case of delivery of a gift, then you accept this signature as an evidence of delivery and fulfilment of your order by the Company. You also accept the associated transfer of responsibility in the same way.  We reserves the right to update its shipping policy at its sole discretion without prior notice. 

 

Liability

The Company does not guarantee that the use of the Platform will be error-free or that the Platform or the servers that make it available are free of viruses or other harmful components. We recommend all users of the Platform to ensure they have up-to-date software, including anti-virus, installed.  Some events may happen beyond our reasonable control, such as adverse weather. Under such conditions, The Company will always do its best to aim at maintaining our services but will not be responsible for failing to meet any obligations in this Terms of Use. 

 

Indemnity and Waiver

You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, licensors and suppliers from and against all claims, losses, liabilities, expenses, damages and costs, including, without limitation, attorneys' fees, arising from or relating in any way to your User Generated Content, your use of Content, your use of the Platform, your conduct in connection with the Platform or with other Platform users, or any violation of this Terms of Use, any law or the rights of any third party.

If you breach this Terms of Use and we take no action against you, it is no wavier for us to exercise our rights and remedies in any other situation where you breach this Terms of Use.

 

Privacy 

The Company’s Privacy Policy, which is incorporated into this Terms of Use by this reference, further describes the collection and use of information on this Platform. 

 

WARRANTY DISCLAIMER 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PRODUCT LIABILITY AND NON-INFRINGEMENT.  TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DOES NOT MAKE ANY WARRANTIES OR REPRESENTATIONS REGARDING THE USE OF THE MATERIALS OR CONTENT IN THE PLATFORM IN TERMS OF THEIR CORRECTNESS, ACCURACY, ADEQUACY, USEFULNESS, RELIABILITY OR OTHERWISE.  THE COMPANY RESERVES THE RIGHT TO CHANGE ANY AND ALL CONTENT AND OTHER ITEMS USED OR CONTAINED IN THE PLATFORM AT ANY TIME WITHOUT NOTICE. 

 

LIMITATION OF LIABILITY 

THE COMPANY SHALL NOT BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA, THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE, THIS PLATFORM OR THE PERFORMANCE OF THE PRODUCTS PURCHASED THROUGH THE PLATFORM OR THE CONDUCT OF OTHER PLATFORM USERS (WHETHER ONLINE OR OFFLINE) OR ATTENDANCE AT A THE COMPANY EVENT OR ANY USER GENERATED CONTENT, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOU ASSUME TOTAL RESPONSIBILITY FOR YOUR USE OF THE PLATFORM. YOUR ONLY REMEDY AGAINST THE COMPANY FOR USE OF THE PLATFORM OR ANY CONTENT IS TO STOP USING THE PLATFORM. THAT SAID, IF THE COMPANY IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH IS IN ANY WAY CONNECTED WITH YOUR USE OF THIS PLATFORM OR ANY CONTENT, THE COMPANY'S LIABILITY SHALL NOT EXCEED HK$100.00. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. 

 

Miscellaneous 

You agree that this Platform, Terms of Use, Privacy Policy and any dispute between you and the Company (“Dispute”) shall be governed in all respects by the laws of Hong Kong, without regard to choice of law provisions.  Except where prohibited, you agree that all disputes, claims and legal proceedings directly or indirectly arising out of or relating to the Platform (including but not limited to the purchase of the Company products) shall be resolved individually, without resort to any form of class action, and exclusively in the court having jurisdiction over the dispute in Hong Kong in accordance with the laws of Hong Kong. You consent to waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in the courts having jurisdiction over the dispute in Hong Kong. By using the Platform, you agree to receive certain electronic communications from the Company.  You agree that any notice, agreement, disclosure or other communication that the Company sends you electronically will satisfy any legal communication requirements, including that such communications be in writing.  The Company’s failure to insist upon or enforce strict performance of any of these Terms of Use shall not be considered a waiver of any provision or right.  Neither the course of conduct between the parties nor trade practice shall modify any of these Terms of Use. The Company may assign its rights and duties under these Terms of Use to any party at any time without notice to you. 

 

Severability 

If any provision in these Terms of Use is held invalid, the remainder of these Terms of Use shall continue to be enforceable. If any provision in these Terms of Use is deemed unlawful, void or unenforceable, then that provision is deemed severable from these Terms of Use and the remaining provisions are still valid and enforceable. 

 

Termination 

The Company reserves the right in its sole discretion to terminate your account, delete your profile and any of your User Generated Content, and restrict your use of all or any part of the Platform for any or no reason, without notice, and without liability to you or anyone else.  The Company also reserves the right to block users from certain IP addresses or Device numbers and prevent access to the Platform. You understand and agree that some of your User Generated Content, such as that which is displayed outside your profile, in activity feeds, in other parts of the Platform, or on other platforms (e.g. Weibo, Google, etc.), may continue to appear on the Platform or on other platforms even after your User Generated Content is removed or your account is terminated.  These Terms of Use remain in effect even after your account is terminated. The Terms of Use relating to Intellectual Property, Warranty Disclaimer, Limitation of Liability, Miscellaneous, Severability and terms that by their nature may survive termination shall survive any termination.

感謝您通过電腦、筆記本、移動終端或者其他設備（統稱“設備”）瀏覽本平台。您可以根據以下服務條款及任何其他本平台所提及的條例(統稱“服務條款”)存取或使用本平台或相關服務(統稱“服務”)。使用服務,例如於本平台訂貨,即表明您已經閱讀、理解並同意受本使用條款和其他適用法律約束，不論您是否為本公司的註冊用戶。本公司有權在任何時間不經通知地修改這些使用條款，並於公佈在平台之時起生效。您對本平台的繼續使用應被理解為您對經修訂的本使用條款的接受。如果您不同意這些使用條款，請停止使用本平台。 

 

知識產權 

本平台（除使用者生成內容外（見下述定義））全部知識產權為本公司或其許可人所有。全部商標、服務商標和產品名稱為本公司所有、註冊和/或許可的。本平台全部內容（除使用者生成內容外）、互動功能和所有其他內容（簡稱“內容”）為香港法下的彙編作品，且為本公司的專有財產。本公司保留所有權利。除非獲得本公司明確書面同意，否則嚴禁使用本公司商標。

 

平台使用限制 

您只能為您自己的非商業用途使用本內容參與本平台、下訂單或購買產品。您同意不修改或刪除任何您下載的資料或從本平台列印的資料上的所有權聲明。您不得改變、複製、翻譯、展示、散佈、設計、生產、再版、下載、發表、傳輸或銷售任何本平台上出現的知識產權或內容，包括使用者生成內容，除您自己合法發佈於本平台的使用者生成內容除外。您同意不使用任何資料採擷、資料抓取或其他相類似的資料收集方法。本使用條款中任何內容不應被解釋為給予您任何知識產權。 

 

產品訂單

展示於本平台的價格和其他產品資訊僅為要約邀請，且您的訂單應被視為要約。所有通過本平台完成的訂單需經本公司的接受。只有當本公司向您發出確認電子郵件，才構成本公司對您的訂單的接受，本公司和您之間的訂購合同才成立。如果您在一份訂單裡訂購了多種產品，而本公司只向您發出了其中部分產品的發貨確認電子郵件，那麼本公司和您之間的訂購合同僅就該部分產品成立。這意味著本公司可以按照本使用條款或其他正當理由拒絕接受或可以撤銷任何訂單，並不對您或其他任何人承擔責任。 

 

禁止代購銷售 

本平台僅為向終端消費者提供需要的本公司產品，並不允許任何形式代購銷售。

 

訂單取消 

您同意，本公司在下列情況下，可以取消您的訂單，通過原付款平台向您退回您支付的相關貨款（如適用），並無須補償：

- 本公司網站上顯示的產品資訊明顯錯誤或缺貨的；

- 價格錯誤；

- 平台技術問題；

- 您的訂單資訊錯誤或您訂購數量超出本公司備貨量的；

- 因不可抗力、傳輸遲延、本公司網站系統發生故障或遭受第三方攻擊，及其他本公司無法控制的情形，根據本公司判斷需要取消您的訂單的；

- 您未能在本公司規定時間內完成支付的；

- 經本公司判斷，您使用技術手段侵入本公司網路進行購買；

- 以代購銷售為目的進行購買的；

- 假借他人帳戶或身份進行購買；或

- 其他違反本使用條款、購買規則、本平台其他相關規則、政策、或網頁活動規則中限制、禁止的行為或不符合公平原則或誠實信用原則的情形（如您多次無正  

 當理由拒收訂購產品，惡意佔用庫存等）。 

 

用戶名/密碼保護 

您將為您本公司帳戶作出的任何行為負責。本公司對任何非授權的使用您用戶名/密碼的行為所造成的結果不承擔任何責任，不論該非授權使用您是否知曉。 

 

使用者生成內容 

“使用者生成內容”為通信、資料、資訊、評價、圖片、文件、訊息、通知、網站連結、文本資訊、音樂、視頻、設計、圖表、聲音和其他任何您和/或其他本平台用戶發佈於本平台或以其他形式使其於本平台或通過本平台可見的內容，除非該內容由本公司所有。 

 

我們可能對您的帳戶採取相關行動(如終止您的帳戶)而不作通知，若您： 

- 使用任何技術企圖隱藏使用多個帳戶,或以任何方式擾亂我們任何服務；

- 發起任何含有非法、傷害、恐嚇、濫用、騷擾、誹謗、粗俗、淫褻、褻瀆、仇恨、會引起種族和民族反感成分的資料的訊息；

- 宣傳或發送任何濫發訊息；或

- 冒充他人或提供任何虛假資料。

 

您對您的使用者生成內容、您與其他使用者的互動和您在本平台上的行為全權負責。請勿作出任何行為或發佈任何內容使本公司或其用戶可能受到任何傷害或承擔任何責任。 

 

購買資格

如要在本公司購物,您須符合以下條件：

- 年滿18歲或以上;

- 持有本公司接受作為付款方式而且由持牌銀行發出的有效信用卡或轉帳卡,或持有有效的PayPal帳戶;及

- 保證您所提供的個人及付款資料為有效而且正確(包括電郵地址、真實姓名、電話號碼、記帳資料和其他本平台要求的資料

 

於本平台訂購貨品,即表示您授權本公司於您的信用卡/轉帳卡或PayPal帳戶收取金額為訂單總額的費用。您亦明確授權我們使用您所提供的個人資料進行適當的反詐騙檢查,例如信用審查,以及在必要的時候,向第三方或從第三方傳送或獲取關於您的資訊。第三方包括但不限於信貸參考機構或反詐騙機構,而此等機構可能保存有關資料。如欲了解更多關於本公司如何使用個人資料的資訊請參閱我們的私隱政策。

 

所有訂購貨品受倉庫供應情況和確認。購物籃中的貨品不設預留,而且有可能被其他客戶購買。

 

產品描述

本公司將盡力確保本平台的內容和產品描述為準確和完整。不過,我們不保證內容和產品描述均為準確、完整、最新和無誤。

 

價格

本平台所標示的價格為港幣。除非出現明顯錯誤,否則您的訂單獲接納時即代表您同意支付本平台所顯示的價格。我們盡力確保本平台所顯示的所有價格準確,但不能保證所有價格無誤,並保留更正任何錯誤的權利。如果我們發現您已訂購的任何產品價格有誤,我們會盡快通知您,屆時您可選擇重新確認或取消訂單。如果未能聯絡閣下,我們將把訂單作取消訂單般處理。

 

如果您的信用卡/轉帳卡不是港幣戶口,最終收費會以您的戶口貨幣由您的發卡銀行根據其處理交易當天的適用匯率計算。

 

付款 

我們接受客戶以Visa、MasterCard、American Express和Paypal付款。如使用以上信用卡/轉帳卡及網上付款方法,即表示您確認您為該信用卡/轉帳卡或PayPal帳戶的持有人,獲得持有人授權使用。如果您的信用卡/轉帳卡發行機構拒絕授權向我們支付款項,我們將對於為任何延遲或停止送貨的情況概不負責。

 

我們的交易過程符合支付卡產業設定的嚴格國際安全標準,令您體驗既安全又有保障的購物過程。在我們沒有出現疏忽的情況下,如果任何第三方未經授權獲得您在使用我們服務時所提供的資料,我們對您可能遭受的任何損失概不負責。

 

接受訂單

當您輸入個人資料並提交訂單及收到您的付款,我們將向您發出確認電郵。屆時即表示您的訂單已獲接受,而您與我們的合約亦已完成。因此,所有的銷售合約以英文在香港特別行政區訂立。我們保留權利因任何原因自行決定不接受訂貨。如果您的訂單有任何問題,我們會盡快聯絡您。

 

取貨

於貨品交付給您時,您開始為貨品承擔責任。如果收貨人或提取人不是原來購買者,或者交付的是禮物,即表示您接受上述人士的簽署確認為送貨證據並表示我們已完成您的訂單,同時接受相關的責任轉移。

 

責任

我們不保證使用本平台和服務均為無誤,也不保證本平台或支援本平台的伺服器沒有病毒或其他有害成分。我們建議所有本平台的用戶確保自己已安裝最新軟件,包括防毒軟件。某些事情可能在本公司的合理監管之外發生,例如惡劣天氣。在此等情況下,我們會盡力維持服務,但對於任何未能滿足本服務條款的責任概不負責。

 

賠償及豁免

您同意賠償、辯護、使本公司及其關聯公司、管理人員、董事、雇員、代理人、許可人以及供應商免受任何指控、損失、責任、費用、損害，包括但不限於，由於您的使用者生成內容、您對內容的使用、平台使用、您關於本平台或平台其他用戶的行為、或對本使用條款的違反、違法或侵犯第三方權利所引起的或與之相關的律師費用。 

 

如果您違反服務條款而我們沒有對您的行為採取任何行動,並不代表本公司放棄在其他違反服務條款的情況下行使我們的權利和解決措施。

 

隱私 

我們的隱私政策為本使用條款的組成部分，將進一步解釋本平台對資訊的搜集和使用。 

 

免責聲明 

在適用法律所允許的最大範圍內，本公司否認所有明示或暗示擔保，包括但不限於標題的隱含擔保、適銷性、針對特定用途的適用性、產品責任和不侵犯性。本公司不保證且不承諾任何使用本平台所引起的任何後果。在適用法律所允許的最大範圍內，本公司對平台資料和內容的使用的正確性、充分性、有效性、準確性、可靠性等不作任何保證或陳述。本公司保留隨時更改任何和全部本平台包含的或本平台使用的內容和其他專案且不必事先告知的權利。 

 

責任限制

本公司不對任何由於使用本平台或不能使用本平台、自本平台購買的本公司產品、本平台其他用戶的行為（不論線上的還是線下的）、參加本公司活動或任何使用者生成內容而引起的直接的、特殊的、偶然的，間接的結果損害承擔責任，包括任何利益損失或資料遺失，即使本公司已經被告知此類損害的可能性。您對使用平台造成的損害承擔全部責任。您由於使用本平台或其內容而造成損害的唯一補償措施既是停止使用本平台。對您由於該平台或內容所造成的任何損害或損失，本公司的賠償責任不超過100港元。適用法律可能不允許限制或排除承擔偶然或必然損失的責任，如是，則上述限制或排除不適用於您。

您同意關於本平台、本使用條款、隱私政策以及任何您和本公司之間的糾紛（簡稱“糾紛”）均適用香港法律，除衝突規則外。除非另有禁止，您同意所有由此平台直接或間接產生的或與之相關的糾紛、索賠和訴訟（包括但不限於本公司產品的購買）應單獨解決，不訴諸任何形式的集體訴訟，且均應提交香港有管轄的法院依照香港法律解決。您同意放棄全部向香港有管轄的法院提出不方便管轄的抗辯的權利。通過使用本平台，您同意接受本公司發出的特定的電子通訊資訊。您同意本公司發送的任何電子通知、協定、披露或其他通信滿足法律通訊要求，包括該等通信資訊應為書面作出的。本公司未能嚴格執行任何本使用條款中的條款將不被視為放棄該等條款或權利。不論是雙方行為還是貿易實踐均不能對本使用條款進行修改。本公司可在不事先通知的情況下，在任何時間轉讓本使用條款下的任何權利和義務給任何第三方。 

 

可分割性 

如果這些使用條款中的某一條款無效，不影響其他條款繼續有效。如果這些使用條款中的某一條款被認定是違法、無效或不可執行，則該部份將被視為與本使用條款相分割，所有使用條款的其餘條款之有效性及可執行性均不受其影響。 

 

終止條款 

本公司保留不經通知，以任何理由或無理由單方終止您帳戶、刪除您用戶個人資料以及其使用者生成內容以及限制您使用本平台的全部或部分的權利，並且不對您或任何人承擔責任。本公司同樣保留阻止用戶從特定的IP位址或者設備登陸平台的權利。您理解並同意即使您的使用者生成內容被刪除或您的帳戶被終止，您的一些使用者生成內容，如您存儲於個人資料之外的、位於活動資訊的、在本平台其他部分的，或在其他平台上的（如，微博、谷歌等等）使用者生成內容，可能會繼續出現在本平台或其他平台上。您的帳戶被終止後，這些使用條款仍然有效。涉及知識產權的條款、免責聲明、責任限制條款、其他條款、可分割性條款以及其他按其性質可繼續適用的條款將於本使用條款終止後繼續適用。
